If you owe HMRC some money and haven’t paid it and the debt is increasing then eventually HMRC may issue a Winding Up petition against your company. This means that they want your company shut down and liquidated. This can obviously have catastrophic consequences on you and your business.

We are experts at dealing with either a “Warning of Winding Up Action” letter from the Late Stage Debt Resolution team or a letter from Worthing or Cardiff office stating that “if you do not make payment, in full, within 7 days of the date of this letter I will instruct the solicitor of HMRC to present a petition to the High Court to wind up the company” or if you have actually received a winding up petition from the High Court of Justice.
HMRC don’t issue winding up petitions lightly so it must mean that you have gone through various stages of Debt management before your file gets to the office of HMRC that will issue the winding up petition.
There are only two offices of HMRC in England & Wales that can issue a winding up petition and they are Worthing Office in West Sussex and Cardiff office in South Wales. So, if you are receiving letters or phone calls from Worthing or Cardiff offices of HMRC you are in a serious situation. However, we deal with these offices on a daily basis and have the direct lines of many staff there and have good relationships with them. We can quite often get winding up petitions delayed, adjourned or even withdrawn.
We know HMRC’s winding up timescales process intimately. For example all HMRC winding up hearings are always held on Wednesdays at the High Court on Fetter Lane in London and normally about 6 weeks from the date of the petition being issued.
If you receive a “Warning of Winding Up Action” letter from an office of HMRC other than Worthing or Cardiff then you are not in such a serious situation and have a bit more time but nevertheless you probably still need our help.
